1. What is the status of the product certification certificate, what are the status of the certificate, and what is the meaning of each status?
 
The status of product certification certificate is commonly referred to as "certificate validity". Product certification certificate status is generally divided into the following five categories: valid (normal), suspended, revoked, cancelled, certificate expired. The five states are described in detail below:
 
The "effective" status indicates that the product, service and management system can continuously meet the certification requirements, and the certificate can continue to be maintained.
 
The status of "suspension" indicates that the certification authority finds that the certification client (or certificate holder) can not continuously meet the certification requirements in the process of tracking and investigating the certified products of the certification client (or certificate holder), or the enterprise or product of the certification client (or certificate holder) needs to suspend the certificate, and the certification principal (or certificate holder) shall take the initiative to the certification body If a suspension application is made, the certification authority will make a decision to suspend its certification certificate according to its specific situation. After the suspension period, the certificate status may be restored or revoked. After the applicant applies for restoration, the certification authority shall determine whether the certificate can be restored.
 
The "revocation" status indicates that the certification authority finds some serious cases which can not meet the certification requirements continuously in the process of tracking and investigating the certification client (or certificate holder) and its certified products, then the certification authority will make a decision to cancel its certification certificate according to its specific situation. "Revocation" status indicates that the authentication certificate is invalid and cannot be restored for any reason.
 
The "cancellation" status indicates that the product certification certificate has the situation of canceling the product certification certificate. According to the regulations or the application of the certificate certification client (or certificate holder), the product certification certificate is cancelled. 4. What are the suspension, revocation and cancellation of product certification certificate?
 
1、 In case of the following situations, CQC will "suspend" the product certification certificate
 
(1) The certification client (or certificate holder) / relevant parties (including producers, sellers, importers and manufacturers, the same below) violate national laws and regulations, and the results of national or provincial supervision and random inspection prove that the products are unqualified, but the certification certificate does not need to be revoked immediately;
 
(2) The certification basis or certification implementation rules applicable to the certified product are changed or changed, and the certification client fails to perform the change procedure as required within the specified period, or the product fails to meet the change requirements;
 
(3) The results of supervision and inspection prove that the certification client (or certificate holder) violates the provisions of national or CQC related certification implementation rules (including unqualified product sampling inspection, unqualified factory supervision and inspection, product consistency problems, etc.) or relevant requirements of certification body, but the certification requirements can be met through rectification;
 
(4) The certification client (or certificate holder) / relevant party fails to use the certification certificate and certification mark according to the provisions, and conducts investigation according to the circumstances;
(5) The certification client (or certificate holder) / relevant party does not accept or cannot accept the supervision and inspection or supervision sampling test without prior notice from the relevant national departments or certification bodies within the specified period without any justifiable reason;
 
(6) The certification client (or certificate holder) / relevant party fails to cooperate with relevant national departments or certification bodies to take samples in the market or sales places for testing according to the national or CCC Certification Implementation Rules;
 
(7) The information of the certification certificate (such as the name or address of the applicant / Producer / manufacturer, the model or specification of the certified product, etc.) changes or there is evidence indicating that the organizational structure and quality assurance system of the manufacturer have changed significantly, and the certification client (or certificate holder) has not applied to the certification authority for change approval or filing;
 
(8) The certification client (or certificate holder) applies for suspension of certification certificate due to seasonal production, production according to order, etc;
 
(9) Other circumstances in which the certification certificate shall be suspended;
 
2、 In case of the following situations, CQC will "Cancel" the product certification certificate
 
(1) At the expiration of the suspension period of the certification certificate, the certification client (or certificate holder) does not apply for the restoration of the certification certificate, does not take rectification measures, or is still unqualified after rectification
 
(2) The key components, specifications and models of the certified products, as well as the design, structure, process and production enterprises of important materials / raw materials related to the safety of the whole machine or electromagnetic compatibility are changed, resulting in serious potential safety hazards
 
(3) The follow-up inspection results of the certification body prove that there are serious defects in the quality assurance ability of the factory
 
(4) The certification client (or certificate holder) provides false samples, and the certified products are inconsistent with the type test samples
 
(5) The certification client (or certificate holder) / relevant party violates the national laws and regulations, and the national or provincial supervision and random inspection results prove that the product has serious defects, the product safety testing items are unqualified or there are serious problems in the consistency;
 
(6) Quality and safety accidents caused by defects of certified products;
 
(7) Refusing to accept the supervision and inspection or supervision sampling test after the certification certificate has been suspended due to the reasons mentioned in the first point (5) and (6), or still fails to cooperate in sampling samples in the market or sales places for testing;
 
(8) The certification client (or certificate holder) / relevant party fails to use the certification certificate and certification mark according to the provisions, rents, lends or transfers the authentication certificate and certification mark, and the circumstances are serious;
 
(9) Using fraud, cheating, bribery and other improper means to obtain the certification certificate, or other serious violations that directly affect the effectiveness of the certification results;
 
(10) Other circumstances in which the certification certificate should be revoked (such as violation of special requirements in the implementation rules of certification, etc.)
 
3、 In the following cases, CQC will "Cancel" the product certification certificate
 
(1) When the validity period of the authentication certificate expires, the certification client does not apply for extension of use
 
(2) The certification client (or certificate holder) / manufacturer voluntarily gives up the certification certificate due to the enterprise bankruptcy, bankruptcy, dissolution, production structure adjustment and other reasons
 
(3) The model of the certified product has been listed in the catalogue of products which are eliminated or prohibited by the state
 
(4) The certification principal (or certificate holder) applies for cancellation
 
(5) Other circumstances in which the certification certificate shall be cancelled
4、 Handling of specific situations
 
(1) For ODM manufacturers, when the certification certificate of the original certified product or one of the ODM certified products is suspended, cancelled or revoked due to unqualified product testing, CQC shall adopt the same treatment method for the original certified product certification certificate and ODM certified product certification certificate.
 
(2) If the certification client (certificate holder) / relevant party violates national laws and regulations, does not accept / cooperate with the supervision of relevant national departments and some special circumstances, CQC shall arrange and deal with it according to the specific situation.
 
(3) For the suspended certification certificate, if there are other conditions that should be suspended within the certificate suspension deadline, CQC relevant departments that find problems will put forward opinions to add suspension clauses and shorten the suspension period of certification certificates accordingly.
 
5. What is the workflow for CQC to suspend, cancel and cancel the product certification certificate
 
Any suspension, revocation and cancellation of CQC's product certification certificate is a process from acceptance, processing suggestions, evaluation and final decision-making, which needs a certain period of time to complete. CQC's processing of product certification certificate is generally completed through the following workflow:
 
1、 To make a proposal or application for suspension, cancellation or cancellation:
 
CQC and the certification client (certificate holder) can put forward suggestions on suspension, revocation and cancellation. Among them, CQC can only propose the proposal of revocation of certificate, which is as follows:
 
(1) CQC Through supervision and inspection, problems are found and suggestions are put forward: Supervision and inspection results (including routine supervision and inspection, supervision and inspection without prior notice or supervision sampling inspection, etc.) prove that the certification client (or certificate holder) violates the provisions of national or CQC related certification implementation rules (including unqualified product sampling inspection, unqualified factory supervision and inspection, and consistent products) If there are problems in the use of the certificate mark, etc.) or the relevant requirements of the certification authority, the certificate will be suspended or revoked after being confirmed by the evaluation personnel of the certification body;

At the same time, the certification client (or certificate holder) should also report the inspection / spot check results to the certification authority after being informed of the problems, and actively cooperate in the rectification or rectification.
 
(3) In case of other cases where the certificate is suspended, revoked or cancelled by the certification authority after obtaining the certificate, or the certificate needs to be handled due to the application and complaint, CQC can directly put forward suggestions on suspension, revocation and cancellation of the relevant certificate after relevant investigation.
 
(4) The certification client (certificate holder) can also directly apply for suspension or cancellation of certification certificate to CQC according to its own actual situation, and mail it to each CQC sub center or relevant department of the manufacturer, and each CQC sub center or relevant department will accept the application directly after receiving the application. However, for the unqualified enterprises, it is not allowed to apply for cancellation of the certificate before the rectification is qualified.
2、 Material review and handling suggestions
 
After receiving the materials submitted by the proposer, CQC verifies whether the materials meet the requirements, and puts forward handling suggestions after reevaluation.
 
3、 Preliminary evaluation, reevaluation and final treatment suggestions
 
CQC departments concerned shall conduct preliminary evaluation and re evaluation on the received materials according to relevant requirements after receiving relevant data of handling opinions. For the handling opinions with doubts, a handling group will be set up to analyze the different opinions and give the final treatment opinions
 
4、 Approval, notice issuance and information release
 
The final handling opinions shall be approved by the leaders of CQC center, and then the certification decision shall be made.
 
CQC will send the certification certificate processing information to the certification client (certificate holder) (or the relevant personnel entrusted by the certification principal (certificate holder) through the product certification online application system on the date of approval of the final processing opinions. CQC The customer service center of the comprehensive business department shall print the notice of suspension of certification certificate, notice of resumption of certification certificate, notice of revocation of certification certificate and notice of cancellation of certification certificate within 2-5 working days after the approval of certificate processing decision, and send the certification client (certificate holder) to inform them of the reasons and necessary measures to be taken in the next step, and retain the authentication in an appropriate manner A record that the certificate holder has been informed of this information. In daily work, certification bodies shall strengthen information communication and cooperation with local certification supervision departments and law enforcement (inspection) departments, and timely collect illegal information of supervision and law enforcement, special supervision and random inspection at all levels, complaints from interested parties, media exposure and other market or industry regulatory authorities. For products involving compulsory certification, certification bodies shall assist in the investigation of illegal acts and shall, in accordance with the relevant regulations, assist in the investigation of illegal acts The relevant certification certificate shall be suspended, revoked and other follow-up measures.
 
6. What are the contents of the suspension / revocation / cancellation notice?
 
The notice of suspension / revocation / cancellation generally includes the following contents: reasons for suspension / revocation / cancellation, number of suspension / revocation / cancellation certificate, suspension period, department accepting resumption application or change application, effective date of suspension / cancellation / cancellation notice.
 
7. After the product certification certificate is suspended, revoked or cancelled, can the products covered by the certificate be used in the factory, sale, import or other business activities?
 
1、 For the suspended product certification certificate, the suspension period shall be deemed invalid, and the products covered by the certificate shall not be manufactured or imported during the suspension period. The certification client (or holder) shall suspend the use of certification certificate and certification mark, inform all existing and potential purchasers of the certification status, and suspend the promotion or declaration of the certification information of the products involved in this notice. If necessary, please recall the delivered products.
 
2、 As for the revoked product certification certificate, the products covered by the certificate shall not be used in factory, sale, import or other business activities from the date of revocation of the certificate. The certification client (or holder) shall stop using the certification certificate and certification mark, and stop publicizing or declaring the certification information of the products involved in this notice.
 
3、 For products whose certificates have been cancelled or expired, the products covered by the certificates may not be sold or used in other business activities. The certification client (or holder) shall stop using the certification certificate and certification mark, stop publicizing or declaring the certification information of the products involved in this notice.
 
4、 After the product certification certificate is cancelled or cancelled, the certification client (certificate holder) shall return the original certificate to the product certification customer service center of CQC comprehensive business department. The longest storage life is 3 years, and it will be destroyed if it is overdue.
 
8. What is the validity of the certificate after revocation and cancellation, and whether it can be restored or regained?
 
1、 After the product certification certificate is revoked, it cannot be restored for any reason. After rectification, the holder can apply to CQC for certification again after 6 months (at the same time, no certification agency will accept the certification entrustment of the product within 6 months). For products whose compulsory product certification has been revoked, the corresponding product type test report and factory inspection report are no longer valid. When accepting the certification application with product type test report and factory inspection report, CQC will strictly review and confirm whether the certification certificate of the product applying for certification has been revoked.
 
2、 After the product certification certificate is cancelled, it can not be restored for any reason. The certification client (certificate holder) can apply to the certification authority again for certification. The type test report and factory inspection report of the products whose certification certificate has been cancelled are no longer valid.
 
If the certificate is suspended due to quality problems (such as factory inspection failure, sampling test failure, national and local sampling failure, etc.), the certificate holder's application for cancellation of the corresponding certificate or all or part of the model specifications will not be accepted after the certificate is suspended.
9. How to determine the suspension period of product certification and whether annuity should be paid during the suspension period?
 
1、 Determination of suspension time limit:
 
(1) If the certification client (certificate holder) proposes to suspend the certification certificate due to the seasonal production, production according to order and other acceptable reasons, the suspension period of the certification certificate shall be 12 months, and the application shall be filed at least 1 month before the supervision and inspection; if the certificate is suspended due to the non payment of relevant fees, the name of the applicant / Producer / manufacturer of the certificate shall be given If the certificate is suspended due to the change of name or address or relocation of the factory, the suspension period of the certificate shall be 12 months.
 
(2) For products subject to compulsory certification, if the certification certificate is suspended for other reasons except for the case in point 1, the suspension period of the certificate shall be 3 months.
 
(3) For voluntary certification products, the suspension period is 12 months.
 
(4) The suspension time shall be calculated from the date when the certification authority issues the suspension notice.
 
2、 During the period of suspension of certification certificate, the certification client (certificate holder) must pay annuity.
 
10. When can the product certification certificate be suspended?
 
The certification client (certificate holder) shall fill in the application form for resumption of product certification certificate within the suspension period of certification certificate (for the suspension period, please refer to the notice of suspension of certification) to apply for restoration. If it fails to apply for restoration within the suspension period, it shall be deemed that the certification client (certificate holder) voluntarily gives up the application for restoration, and the corresponding certification certificate will be revoked.
 
In view of this, the certification client (certificate holder) should actively take measures to eliminate the reasons for the suspension after obtaining the information of the certificate being suspended. At the same time, in order to gain more time, it is suggested that the certification client (certificate holder) should apply to CQC for restoration as soon as possible.
